Eviction Policy

  • Hi, we are a German/American family that own a house in Wuerzburg. We are renting it out right now, but the renter has not paid rent since October. We have already asked her for the rent a few times. I have already talked to a lawyer, and he said I kick her out without a three month notice, due to her not paying. But he said telling her she is out, and her actually being out is different. He said it can take up to a year for her to actually get out. Does anyone know what rights we have to kick her out? We can not afford to have her living there, and not pay rent. We have a house, with a attached apartment (Einliegerwohnung), so if we are legally allowed, we can move her into the apartment. It is just a two room apartment, and it is her and three kids. But if she is not paying rent, we need to either move back in there, or rent it out to someone that will pay rent.
